1. Identification & Agreement

As part of our commitment to protecting our intellectual property and ensuring compliance with U.S. and international copyright laws, this Licensing Agreement must be completed and signed before gaining access to the CYMO Pro family of indicators (the “Software”).

2. Intellectual Property Rights & License Terms

Ownership & Restrictions

• The Software, algorithms, source code, and all associated content remain the exclusive property of The Algo Trader, LLC.

• The Software is protected by U.S. and international intellectual property laws.

Prohibited Actions
You acknowledge and agree that:

• The Software is encrypted and source code access is strictly prohibited.

• Any attempt to reverse engineer, decrypt, modify, share, distribute, or resell the Software will result in immediate license termination and potential legal action.

• Violations may incur civil and/or criminal penalties.

License Scope & Duration

• You are granted a limited, non-transferable, revocable license for personal, non-commercial use only.

• Your license remains valid only while your subscription is active and in good standing.

• Upon cancellation, expiration, or revocation of your subscription, you agree to immediately cease all use of the Software.

3. Acknowledgment of Payment Terms & Waiver of Chargebacks

• You understand that this is a non-refundable software license, and once the license has been activated on your NinjaTrader platform, no refunds or chargebacks are permitted.

• You affirm that:

  • You are the authorized user of the payment method provided.

  • You are knowingly and willingly entering into this agreement and initiating this transaction.

  • You waive all rights to dispute or charge back this payment with your bank, credit card issuer, or financial institution after activation of your license.

4. Compliance & Verification

• If required, access will only be granted upon successful review by our compliance team.

5. Agreement Confirmation

By submitting this form and e-signing below:

• You affirm that all information provided is accurate.

• You accept and agree to be legally bound by the terms outlined above.

• You acknowledge that failure to comply with these terms may result in license termination, forfeiture of funds, and legal consequences.

By signing below, I affirm that I am the Subscriber listed in this agreement, and that I am licensing this software solely for my personal, non-commercial use. I acknowledge that I have read, understood, and agreed to all terms and conditions outlined in this agreement, including those regarding intellectual property rights, subscription-based access, and the waiver of refund or chargeback claims after license activation.
